Political corruption and the proposal to criminalize slush funds in the “Anticrime” Bill

By proposing the typification of keeping a slush fund for electoral purposes as a criminal offense, the conceivers of the “Anticrime” project seek to face the political corruption phenomenon through changes in criminal law. This proposal assumes, wrongly, that every unaccounted donation hides future venality of the public function. The article demonstrates that there are substantial differences between these phenomena, beginning with the distinction among the objects of protection by these criminal offenses. It is concluded that the criminalization of the slush funds, at least in the terms of this proposal, should frustrate the expectations placed on it, besides criminalizing behaviors that do not offend objects of protection by our legal system.
