Abstract

The principle of in dubio pro societate proposes that, in cases of doubt regarding authorship or criminal materiality, the interests of society should prevail, as opposed to in dubio pro reo. In the Brazilian context, there is growing debate about its compatibility with the 1988 Constitution, especially with the presumption of innocence and the burden of proof. Recent case law from the Superior Court of Justice has reaffirmed that this principle has no explicit support in the legal system to justify indictment without sufficient evidence of authorship. Critics point out that its application can lead to arbitrary decisions, violating the fundamental rights of the accused.
