The bargaining agreement and the inexorable advance of consensual justice

This study analyzes the plea bargain mechanism proposed in the Anticrime Bill (Article 395-A and related provisions), understanding it as a normative concession that requires the defendant to confess, waive the proceedings, and receive a reduced sentence in exchange for assuming responsibility, even without full proof of the offense. It highlights the active role of the Public Prosecutor's Office, the risk of generalization of the mechanism, and its tension with constitutional guarantees such as the right to a fair trial, the presumption of innocence, and equality of arms. It also examines the impact of this consensual regime on structural inequality, possible overcharging, and practical implications for the Brazilian criminal justice system.
