The purpose of this article is to discuss the cogent or facultative nature of execution of criminal sanctions rules. For this, it presents a small overview of the notion of execution system. In addition, it addresses two specific issues, namely, the implications of the condemned manifestation of will and the awarding of collaborative agreements in the eventual alteration of the way in which custodial sentences are legally provided.
