Abstract

The purpose of this article is to study the judicial confrontation of the presumption of innocence principle, in cases where a black person is investigated or criminally accused, taking this as an illustration of what happens in the episode Men Against Fire, of Black Mirror series. The aim is to verify the influence of racial markers on the weighting of the principle in question, raising the hypothesis, which is confirmed at in end, that the racial differences that characterize Brazilian society inexorably reproduce themselves in criminal proceedings.
