The fallacy of full guaranteeism

This article critically examines the current known as Integral Criminal Garanteeism, contrasting it with Luigi Ferrajoli's original theory. Classical criminal garanteeism seeks to limit the punitive power of the state through principles such as legality, culpability, necessity, and materiality. Integral garantismo goes further by proposing that the criminal justice system be an active instrument of social justice, including victims and collective rights, and relativizes guarantees in favor of social protection. However, this perspective may contradict the aims of the guarantee theory, as it expands the use of criminal sanctions and restricts individual guarantees. It should be noted that this rhetorical appropriation of the term “guaranteeism” may result in an authoritarian criminal law rather than a system of effective guarantees.
