Issues and perspectives on the criminalization of “slush funds”

This article addresses the proposal to criminalize “electoral slush funds” as conduct involving the maintenance, movement, or use of unaccounted funds in parallel with the required electoral accounting, with a penalty of 2 to 5 years' imprisonment and an increase in the penalty of between 1/3 and 2/3 when a public official is involved. The scope of this new criminal offense, its concrete offensive nature, and the limits of punitive power based on the principle of offensiveness are debated. The relevance of electoral compliance and the need for strict interpretation to avoid legal uncertainty and punitive excesses are emphasized.
