the evolution that did not take hold in the reform

This article analyzes the reforms introduced by Law nº 11.689/2008 regarding jury trials in Brazil, highlighting procedural improvements such as simplification, speed, and enhanced guarantees of defense. However, it criticizes the persistence of convictions based on a simple majority, deemed incompatible with constitutional principles and human dignity. The author argues for the adoption of a qualified majority or the reinstatement of the possibility of a new jury trial, in order to restore balance and fairness in the adjudication of intentional crimes against life.
