Historical reasons for a cruel penal system

If 2,200 prisoners occupy a prison structurally designed for 700, it is obvious that there will be a shortage of water, the sewage system will be undersized for such overcrowding (the sewage will clog and overflow), there will be insufficient prison staff, medical care will be unable to meet demand, inmates will sleep in deplorable conditions, garbage will accumulate, creating a situation very similar to a medieval dungeon. And let us remember that the Federal Constitution prohibits cruel punishment. The same applies to preventive detention. Does anyone doubt that there is any other name for it than cruel when people are imprisoned in compartments used for transporting cargo, or when prisoners receive their food in plastic bags and eat with their hands?
